Terms of Service

Plain-English summary (not a substitute for the terms below): VoteDish is a community rankings, reviews, and local-events site. You can vote, suggest places, post reviews, and upload short clips. You’re responsible for what you post, you grant us a license to display it, the site is provided “as is,” and our liability is limited as far as the law allows.
1. Acceptance of these terms
By accessing or using VoteDish (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you don’t agree, don’t use the Service. We may update these terms; continued use after changes means you accept them.
2. Who can use it
You must be at least 13 years old to use the Service and at least 18 (or the age of majority where you live) to submit content, including reviews, videos, suggestions, and venue claims. By using the Service you represent that you meet these requirements and that your use complies with all applicable laws.
3. The Service is informational, not advice
VoteDish aggregates community votes, user submissions, publicly available business information, and automated data. Rankings, ratings, descriptions, hours, events, prices, and other details may be inaccurate, outdated, incomplete, or generated by automated tools. We do not verify and do not guarantee any of it. Confirm details directly with a business or event organizer before relying on them. Nothing on the Service is professional, health, dietary, financial, or legal advice.
4. User content and conduct
“User Content” means anything you submit: votes, suggested dishes/restaurants/categories, reviews, captions, ratings, video links, uploaded video clips, images, and profile information. You are solely responsible for your User Content.
You agree NOT to submit content that:
- is unlawful, defamatory, harassing, threatening, or invasive of privacy;
- is sexually explicit, pornographic, or depicts nudity, graphic violence, or gore;
- is hateful or promotes discrimination, self-harm, or illegal activity;
- infringes anyone’s intellectual property, publicity, or privacy rights;
- is spam, fraudulent, deceptive, or manipulates votes or rankings (including fake or paid votes, bots, or multiple accounts);
- contains anyone’s personal information without their consent, or depicts an identifiable person without their permission;
- contains malware or attempts to disrupt the Service.
You represent that you own or have all necessary rights to your User Content and that it does not violate these terms or any law. For any video or image you upload, you confirm you filmed or created it (or have the creator’s permission) and that everyone identifiable in it has consented to appear.
5. License you grant us
You retain ownership of your User Content. By submitting it, you grant VoteDish a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, publish, publicly display, and distribute that content in connection with operating and promoting the Service. This license continues for content that remains on the Service and for reasonable backup/archival copies after removal. You waive any moral rights to the extent permitted by law.
6. Moderation and removal
We may, but are not obligated to, review, screen, moderate (manually or with automated tools), approve, reject, label, edit, or remove any User Content, and suspend or terminate any account, at any time and for any reason, without notice or liability. Uploaded videos may be held for review before appearing publicly. We are not responsible for User Content posted by others, and we do not endorse any opinions expressed in it.
7. Business listings, claims, and votes
Listings may be created from public sources or user submissions before a business participates. A business representative may claim a listing subject to verification; claiming does not transfer ownership of the listing data or guarantee any ranking, placement, or outcome. Votes are intended to reflect genuine individual preferences; attempts to manipulate results may lead to vote removal and account termination. If paid features are offered, additional terms and fees will be presented at purchase.
8. Third-party content and links
The Service displays and links to third-party content and services (including embedded YouTube, TikTok, and Instagram videos, mapping, ticketing, and business websites). We don’t control and aren’t responsible for third-party content, and your use of it is governed by those third parties’ terms. Embedded or linked videos remain subject to the originating platform’s terms and policies.
9. Intellectual property
The Service itself — including its design, text, graphics, and software (excluding User Content) — is owned by VoteDish or its licensors and protected by law. You may not copy, scrape, reverse engineer, or create derivative works from the Service except as expressly allowed.
10. Copyright / DMCA
If you believe content on the Service infringes your copyright, email info@votedish.com with: (a) identification of the work; (b) the URL of the allegedly infringing content; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (f) your signature. We may remove infringing content and terminate repeat infringers.
11. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION IS ACCURATE OR RELIABLE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOTEDISH AND ITS OWNERS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY USER CONTENT, OR ANY THIRD-PARTY CONTENT OR BUSINESS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $100. SOME JURISDICTIONS DON’T ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless VoteDish and its owners, operators, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these terms or any law or third-party right.
14. Governing law and disputes
These terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Washoe County, Nevada, and you consent to their jurisdiction — except where applicable law gives you the right to bring a claim elsewhere.
15. Termination
We may suspend or terminate your access at any time. You may stop using the Service at any time. Sections that by their nature should survive termination (including licenses for content that remains posted, disclaimers, limitations of liability, and indemnification) will survive.
